Terms of Service & Privacy Policy (Commissions & Patreon Content)
Effective Date: 05/23/2025By commissioning or subscribing to a Patreon page, you ("Client" or "Subscriber") agree to the following Terms of Service. These terms constitute a legally binding agreement between you and us ("Lieut. Clawthorne" and/or "Loiterstein") and are governed by U.S. law.1. Eligibility & General Terms1.1 You must be 18 years of age or older to access or commission any NSFW content. By engaging with our services, you confirm that you are legally permitted to view and possess adult content in your state or locality.
1.2 We reserve the right to refuse or cancel commissions for any reason, including if we believe your request violates applicable U.S. laws or platform policies.
1.3 You agree not to use the commissioned or Patreon content in any manner that violates federal, state, or local law.2. NSFW Content Policy2.1 We only accept adult content that is fictional and consensual in theme and complies with U.S. law.
2.2 We do not accept commissions involving:• Depictions of minors or underage characters (including "aged-up" versions)
• Real-life individuals (e.g., celebrities, influencers, public figures)
• Bestiality
• Non-consensual acts
• Illegal or non-consensual acts in any jurisdiction of the U.S.
2.3 I comply with the standards of the United States Code (U.S.C.) Title 18 Section 2257 in that I do not produce visual depictions of real individuals and all characters in commissioned or posted artwork are fictional and aged 18+ by design.3. Copyright & Licensing3.1 All artwork is protected under the U.S. Copyright Act of 1976, as amended.
3.2 We retain full copyright and moral rights to all original works unless otherwise negotiated in a signed written agreement.
3.3 You are granted a limited, non-transferable, non-commercial license to use the final artwork for personal enjoyment only.
3.4 You may not use our work for:• Resale or redistribution
• Commercial purposes
• NFT minting
• AI training or machine learning datasets
• Public AI image generators
• Pornographic websites or content aggregation services4. Payment Terms4.1 All payments must be made in Euro (EUR) or U.S. Dollars (USD) according to the current EUR to USD exchange rate unless otherwise agreed upon.
4.2 We do not collect or store sensitive financial data; all transactions are processed securely via following services: PayPal (invoices only, international), SBP (Russian Federation residents only)5. Refunds, Edits & Cancellations5.1 If you cancel before work begins, a full refund will be issued.
5.2 If canceled after work begins, a partial refund may be issued, minus the cost of any completed work.
5.3 No refunds are offered once final artwork is delivered.
5.4 If we cancel the project, you will receive a full refund.
5.5 You are provided with an unlimited amount of revisions on the first stage of work. Upon its confirmation, any major edit will come at an extra charge of EUR 40/hour.
5.6 In case any mistake was made on our end (e.g., character design mistake), the edit will be made at no extra cost.6. Jurisdiction & Dispute Resolution6.1 Both parties agree to attempt informal resolution before pursuing formal legal remedies, including PayPal disputes.
6.2 You have a right to open a dispute if at least one of the following conditions are met:• You have not received your product within 150 days since the full payment was made
• You have not received any update on the current status of your commissioned work within 90 days since the full payment was made6.3 If you attempt to open a dispute outside of conditions listed above, either to enforce a full refund of an item you already received, or for any other personal reason, we reserve the right to report your PayPal account along with other known social media accounts for fraudulent activity.7. Digital Content and Platform Use7.1 By subscribing to our Patreon, you agree to adhere to Patreon’s Terms of Use and Community Guidelines.
7.2 You may not redistribute, leak, or sell any files, previews, or downloadable content hosted on Patreon.
7.3 Unauthorized sharing of Patreon-exclusive content may result in a ban, refund refusal, and potential legal action for copyright violation.8. Limitation of Liability8.1 We are not liable for:• Deadline delays caused by customer's long-term lack of communication
• Platform downtimes (e.g., Patreon or Fur Affinity outages)
• Delays caused by third-party services
• Consequences of misuse of artwork by others8.2 In no event shall we be liable for indirect, incidental, or consequential damages arising out of the use of our work or services.9. Privacy Policy9.1 We collect only the necessary information (email address, first and last name, phone number, mailing/billing address) to complete your commission or maintain your Patreon subscription.
9.2 We will never sell, share, or misuse your data in accordance with the California Consumer Privacy Act (CCPA) and relevant privacy regulations.
9.3 You are not allowed to sell, share, or misuse any sensitive data acquired during commission completion (email address, first and last name, phone number, mailing/billing address)
9.4 We reserve the right to store a message history along with any other evidence of doing business with you for up to a year since the payment was made. This data, along with data listed in section 9.1, is only stored for possible dispute resolutions and/or fraud reports.10. Agreement & Modifications10.1 By commissioning us or subscribing, you confirm that you:• Are 18 years of age or older
• Understand and agree to these legally binding terms
• Will comply with U.S. law and these Terms10.2 These Terms may be updated at any time. Major changes will be announced via email, social media or Patreon updates.
Continued use of services after updates constitutes acceptance of the new terms.
